Terms and conditions

1. General

  • These Terms and Conditions apply to all guests of Horta da Rosa, Portugal.

  • Making a reservation means that you agree with the terms and conditions.

  • Adults only from 18+ for both accommodations at Horta da Rosa.

  • We always receive you personally upon arrival. You must identify yourself on request by means of a valid ID. If you are not a Portuguese resident you must also fill in a check-in form. You will receive this upon arrival.

  • The pool is not private. It is shared with 2 other guests.

  • Pets are not allowed. 

  • Parties are not allowed.

  • Horta da Rosa is unfortunately not suitable for wheelchair users.

  • Smoking is not permitted inside the buildings due to fire safety. Smoking outside is permitted.

  • The car can be parked on the property for free, parking is entirely at your own risk.

  • Any visitors to our guests are not allowed without the owner's permission.

  • Visitors are not allowed to spend the night in the accommodation without permission from the owner and without additional payment.

  • There is an information book with the rules for the use of the accommodation, which you can find in your room.

  • In the event of a violation of these terms and conditions and improper behavior, the owner may immediately deny and/ or refuse access to Horta da Rosa without further notice and explanation of reasons and without reimbursement of accommodation costs.

  • Noise nuisance should be avoided, especially between 10pm and 7am. Sound carriers and the like should not be an obstacle for others.

 

2. Rooms and Rates

  • All rates are per room/ house per night, including all services and taxes. 

  • The rates, are including breakfast, towels, and final cleaning and include VAT and tourist tax. Unless otherwise stated on the website.

  • Rooms are available from 15pm on the day of arrival until 12am on the day of departure. A late check-out is also possible for a small additional charge and based on availability.

  • The bedrooms are suitable for overnight stays with a maximum of two people.

  • The entire accommodation is suitable for overnight stays of up to four people.

  • The rates do not include the costs of cancellation or travel insurance and/ or other costs.

  • Horta da Rosa must be kept clean and tidy during your stay and must also be left like that.

  • The rates on the website Horta da Rosa are subject to interim changes.

  • In order to avoid misunderstandings, we would like to point out that the room "White Room" does not have a kitchen.

 

3. Reservation and confirmation

 

4. Payment

  • The amount of the reservation must be paid no later than 7 days before the check-in date.

  • If you have had other costs during your stay, these must be paid cash when you check out.

  • Please note that we are unable to accept credit or debit cards.

 

5. Cancellation

  • Cancellations must be notified to Horta da Rosa by e-mail as soon as possible.

  • Up to 7 days prior to the date of arrival, cancellation is free of charge.

  • If canceled within 7 days before the date of arrival (except on the day before check-in), 1 night of the total amount will be charged as reimbursement, the remaining amount will be refund to your account. (not for reservations at booking.com).

  • In the event of cancellation the day before arrival, on the date of arrival itself, on arrival or in the event of early departure, the entire amount of the stay will be charged as compensation. 

 

6. Responsibility

  • All risks related to a stay at Horta da Rosa are for the account of the guests.

  • The owner is not liable for damage, loss or theft of property of the guests. The guest must take all reasonable measures to prevent damage, loss or theft of property. This, for example, by properly closing the accommodation in case of temporary absence. 

  • Damage and loss of movable and immovable property of the owner must be reported immediately by the guests and reimbursed to the owner.

  • In the event of loss or otherwise non-return of keys to Horta da Rosa, all resulting costs will be charged to the main guest. The main guest undertakes to pay this within 14 days after sending the substantiated invoice.

 

7. Liability

  • Horta da Rosa cannot be held liable by the guest or third parties in the following situations such as: disruptions in and around the accommodation, disruptions of the Wi-Fi network, power outages, problems with water supply and technical installations, non-timely or announced construction and/ or construction or road works near the accommodation.

  • Horta da Rosa can only be held liable for damage that is due to the gross negligence or negligence of the owners themselves.

  • Horta da Rosa is described in the website www.hortadarosa.com. This website has been compiled with the greatest care, but there may be differences between the text and/ or photos presented on the website and the current situation at Horta da Rosa at the time of the visit by the guests. No rights can be derived from such differences by guests.

 

8. Privacy

  • Horta da Rosa will treat all personal data provided or known to it as confidential and will not make it freely available to third parties, except to comply with legal obligations.

  • You should be aware that Horta da Rosa is not responsible for the privacy policy of other sites, which can be reached via a link on our website. We advise you to consult the privacy statement and disclaimer of that other website when accessing third-party websites via our website. You can see that you are no longer on our website if the URL has changed.

 

9. Data retention period

  • Horta da Rosa does not store your data any longer than for the realization of the purposes for which it was collected and processed.

  • Your personal data will be stored for as long as this is necessary or insofar as this is necessary to meet legal obligations.

  • Our website uses cookies, these are small, simple text files that your computer stores when you visit our website. When you visit our website, you automatically agree to the placement of cookies.
